Ginger Garlic Tempeh & String Bean Bun - Food Porn Version I've decided just to write about cooking rather than always wait until I have a recipe "just right" to post. It will help me recreate delicious things so I can put together a recipe later. These posts will be noted "Food Porn" to show that there's no recipe and have the tag FoodPorn as well, just my going on about something delicious.

Onto the food porn.

Best. Tempeh. Ever. Seriously.

We had in the house pounds of string beans from the garden and Christie asked for tempeh tonight. I stood around in the kitchen for a few minutes before deciding to make a stir-fry. Made up a marinade of ginger, garlic, shoyu, red miso, agave, peanut oil, canola oil, hot chili oil, and water all whisked up together. Diced tempeh went into this yummy mix.

Pulled the the tempeh out of the marinade and set it aside. The tempeh then went into a rather hot wok with some canola oil. Kept tossing it and frying with a lid on until the tempeh was browned. Then I added in a little bit of the marinade to coat the cubes further.

Some sweet onion, a carrot and a little red bell pepper for color were cut up small. All were stir fried with a pile of the green & yellow beans chopped up. After they cooked until the beans started to soften I added in most of the marinade. After the beans were cooked all the way I added the tempeh into the pan and tossed everything together.

Cooked up some rice noodles, vermicelli, which were the weakest part. Tasty, but not great. I'm really going for more of a Vietnamese bun. The noodles were a fine, just not as great as the stir-fry. Added some shredded, Farmers Market lettuce and sliced up cucumbers from the garden.

Yes, I will admit to nearly dancing in glee in the kitchen as this came together. We sat out on the deck in the breeze to enjoy. It was a lot of fun sitting a few feet from the golden string beans growing up the south side of the deck as we ate them for dinner.

Will have to try this whole thing out again with the "right" noodles as well as some cilantro, lime to squeeze over the top and mung bean sprouts. Those things would be a really nice addition to all the flavors. Christie also noted it would be great to have the cucumbers in a little rice vinegar as well. A recipe will be forthcoming on this and really, pictures soon.

Delighted to try out a new snack (I've cut back on crisps generally) and these are pretty unusual.

Pinkfinch Veg Crisps - Crispy Green Beans & Sugar Snap Peas are a nice light snack with an unusual taste. The texture is good, the seasoning is light and tastes not quite like you would expect. Would be great with a little dip. We shared a bag and they were soon gone!

Also in the range are fruit crisps which I am sure will be just as yummy!

You need to step outside of what everyone else is doing so that you can earn links that they don’t have, giving you a unique advantage in your organic search campaign.

To help you earn plenty of valuable links that most of your competitors are too lazy to go after, I’ve outlined 15 tactics you can use to supercharge your link building efforts.

1. Get Readers Engaged with Your Content In the late 1990s, while still serving in the Marine Corps, we had to jump into below-freezing water during Arctic warfare training.

You knew it would be intense, but until you plunged in, completely enveloped by the frigid water, you couldn’t possibly imagine the full intensity.

Your feet broke the surface, and in an instant, you were completely submerged in a brutal cold unlike anything you’ve ever experienced.

You stopped breathing, all of your muscles locked up, and your mind went completely blank.

So what does that have to do with link building?

Absolutely nothing, but it was a compelling story that got you engaged.

If you want to earn quality inbound links, you need your visitors to be engaged and stick around long enough so they can see the value of your content.

If they check out after a few sentences, you have almost no chance of earning a link.

As Alan Bleiweiss explained in a recent article, World-Class Link Building Is More Than Links, your content is the foundation for your link building efforts.

“If you create content that is the kind that people would consider powerful, for a host of reasons, that content is the kind of content most likely to be shared socially, and to have the potential for earning high-quality links.”

I recommend clearly mentioning on your website that you accept cryptocurrency, and once you’ve done that, reach out to everyone who has published a list of crypto-friendly business and ask to be included.

It’s a dead simple way to benefit from cryptocurrency, but instead of capital gains, your profits will come in the form of high-quality links.

1. Build Interactive Data Interactive data is becoming the new infographic because it’s eye-catching, engaging, and informative.

It’s incredibly powerful for link building because it can be an effective tool in helping other bloggers support their position on a topic.

When executed effectively, along with proper outreach, it has the potential to earn a tremendous number of high-quality links.

The key is to come up with a great idea and execute it creatively.

Fortunately, this type of content is cost-effective, and from a technical perspective, relatively easy to produce.

Here are a few examples of interactive data in use:

1. Publish a ‘Best of’ or ‘Top’ Type of Post Listicles tend to perform very well, to begin with, but when you feature the best of a particular topic, the results, in terms of inbound links, can be staggering.

Compiling a list of the top 10, 20, 100, etc., of a particular person, place, or thing is a great way to create valuable content that other people are likely to link to – especially when you consider that in many cases, the people responsible for marketing the people, places, or things in your list are likely already blogging regularly and will be more than eager to link to your post.

Some examples might include:

Better yet, do so beforehand while you’re still planning and writing the post.

1. Publish the Ultimate Resource List for Your Industry I want to be clear that when I say “the ultimate resource list,” I don’t just mean another bland post covering the same 10-20 resources that everyone has already blogged to death.

I’m talking about an all-encompassing list of everything anyone in your industry might ever need, complete with comprehensive descriptions for each item, and where applicable, images.

By the time you click publish on this mammoth list, it should be beautifully formatted, broken down categorically, and contain a table of contents with jump links.

Some of the resources specific to your industry that you might want to include are:

Licencing, governing, and regulatory bodies Top publications Software Data sources Laws pertaining to your industry Schools / educational resources Top podcasts Politicians/legislators involved in your industry Top YouTube channels Industry leaders Employment/staffing firms specializing in your industry Industry associations and trade groups Tools Industry events Facebook/LinkedIn groups Top Books For most industries, this type of list could easily be a 5,000+ word post, and since it’s more than just a list of links because you’ve invested the time and effort to write comprehensive descriptions for each item, most people will simply link to it rather than trying to create their own.

The beauty of this tactic is that since the majority of websites today run on WordPress, you won’t even have to do much outreach because most websites included on your list will be notified that you’ve linked to them.

It still wouldn’t hurt to reach out and ask them to throw a link to your resource list though.

1. Become an Influencer An influencer is someone whose opinion, which might be shared through top-tier publications, social media, and even their own website, is valued by a large number of other people in that person’s industry and/or target market.

I have mixed feelings about the term itself because it’s been so maligned, but the principle behind the term is solid because when you’re considered influential, other people want to get on your radar, which often results in earning more links.

In many cases, influencers will effortlessly earn exponentially more links almost immediately upon publishing a post, simply because of their status.

Beyond that, being an influencer also makes it a lot easier to reach out to others to earn even more links.

You can’t bestow the title upon yourself though.

The “fake it till you make it” approach doesn’t work here, because no matter how much you try to hype yourself up, if you aren’t sharing valuable insights and information, no one will pay attention to what you have to say.

And this isn’t an overnight process — it can take months or even years of hard work and dedication, but the results from a link building perspective can be astonishing.

Josh Steimle, founder of Influencer Inc, explains the thinking behind becoming an influencer in your industry:

“When I ask “Who are you?” I mean what is your genius zone? Your genius zone isn’t merely what you’re an expert at–we’re all experts at lots of things. Your genius zone is usually made up of multiple, overlapping areas of expertise and knowledge that combine to make something truly unique. It will also be something you’re passionate about, an area of focus that feels like your mission in life, the thing you can talk about better than anyone else.

Once you know who you are and what you will share with the world, then the next question is “Who cares?” Who will value your content so much that they’d be willing to pay for it? Perhaps you won’t be charging directly for that content, but if people are willing to pay for it with dollars, but if content can attract dollars it will also attract links.

There are other questions to be answered, like “Where does your audience hang out?” and “How do they prefer to consume content?” but it’s those first two questions that are fundamental. Many of the influential people you know spent years figuring it out, often because they didn’t even know the questions existed. Once you have solid answers for both, you’ll have a foundation you can build on.”

1. Host an Event Who doesn’t love a party?

An event hosted by your business is a great way to get the local media and industry organizations talking – and linking to your website.

It could either be at your office, or elsewhere, provided that the location is suitable. In fact, I’m in the midst of planning an event for later this year in which I will rent a yacht and invite 75-100 executives from the industry that I’m targeting.

The key here is to make sure the event you host has a newsworthy purpose and is beneficial not only to you but also to the attendees and any organizations that are associated with the event.

In fact, associating the event with other high profile organizations is an important step because they’re likely to link to you since the event also helps promote them.

Aligning with a local charity or promoting a good cause is also a good way to get local media involved.

No matter what angle you take though, you’ll still need to conduct outreach to earn those links, and part of that outreach, due to the unique nature of this tactic, should include a press release.

1. Do Something Truly Newsworthy The days of submitting press releases to build links are over.

However, press releases are still a powerful way to earn links.

You might be thinking “That makes no sense, Jeremy! You’ve just contradicted yourself!”

If it seems like a contradiction, it’s because I’m talking about two completely different approaches to link building. That difference is subtle, but critical because one works and the other is a complete waste of time.

The outdated approach to using press releases for link building relies on links embedded in the press release itself. Today, this is largely ineffective both because press releases generally use nofollow links, which make them less effective for SEO, and because Google has devalued this tactic algorithmically.

According to PR expert Cheryl Conner, Founder and CEO of SnappConner PR:

“Think of a press release as the equivalent of a journalistic article. It needs to be interesting and it needs to be evergreen. By evergreen, we mean that it will need to be as relevant six months or a year from now as it is right now. By this thinking, “How to Lead Like Steve Jobs” is an excellent topic for a press release that talks about your webinar or report on the topic, including a link for download or participation both before and after the live event, if there is one, is through. But “We’re having a sale on our educational program” is a terrible topic in that 1) the sale will be over on, say, Wednesday, and 2) after Wednesday it will serve no purpose other than to tick people off who didn’t register in time for the sale.

Let the first portion of the release spell out the 6 W’s of the topic – The Who, What, Where, When, Why and most importantly, Who Cares?”

The proper approach to using press releases for link building relies on doing something that’s actually newsworthy and then publicizing it so that other publications will write about and link to it.

When you do this, the number of links you can potentially earn is exponentially larger.

1. Nurture Relationships with Editors, Journalists & Contributors My accidental success with this tactic has proven more successful than many of the tactics that I approached more deliberately.

What I mean is that I’ve stumbled into friendships with several contributors and journalists simply by helping them solve their problems, and it paid off in massive exposure and links.

I didn’t have any expectations of them doing anything for me, but they did because unlike most people, I didn’t start off by asking for something.

While my initial success with this tactic was accidental, I then went on to execute it more deliberately and achieved even more success.

The key is to identify the journalists and contributors who are not only in your niche but also who seem to align with your personality.

Then, start by becoming valuable to them:

Linking to their content. Engaging on social media by commenting on and sharing their posts. Helping solve their problems when applicable. Before long, you will have formed an army of people both able and willing to assist in your link building efforts.

It’s important to not become entitled or take advantage of these people though, both because that makes you a horrible person, and because it will destroy a valuable link building channel.

1. Become a Contributor at the Publications Your Customers Read It’s great to write for the top publications in your industry because it demonstrates your credibility, but often, your clients don’t read those publications.

For example, while I regularly write for Search Engine Journal and several other digital marketing publications, most of my clients have never heard of them, so it doesn’t mean much to them.

Since my agency is focused on digital marketing for the construction industry, I also write on digital marketing in trade publications covering the construction industry.

My target market already reads and trusts those publications, so that provides a lot more credibility to them while giving me an opportunity to earn links.

You need to figure out what publications your clients are reading and become a contributor there.

The beauty of this link building tactic is that in addition to earning links, it also helps to establish you as the expert within their industry. That makes you infinitely more valuable than any other generalist you’re competing against.

1. Write About Complementary Products/Services It can be difficult to earn high-quality links because many of the most relevant linking opportunities seem to be your competitors, and they probably aren’t eager to link to your website.

Many link builders miss out on a tremendous untapped opportunity because they’re so busy seeking links from websites that offer exactly what they do, that never bother seeking links from websites that offer products/services that are complementary to theirs.

That’s a huge mistake because it’s usually a lot easier to earn links from these websites.

The key is to focus on products/services that play an integral role in the use of your products/services. =

For example, an electrical contractor might write content about:

Alternative energy products OLED lighting EV charging stations Home automation products PV roofing shingles Creating this content is only half of the equation, however, because, in order to earn links from it, you’ll need the people behind the product/services it’s about to know it exists.

Outreach plays a critical role in this tactic, but ideally, this should take place before you create the content because you’ll want to make sure it’s something these people will be interested in linking to. (Since it’s promoting them, they usually will, but it helps to ask first.)

1. Be a Guest on Relevant Podcasts If you’re anything like most people, you typically listen to podcasts on iTunes, but many podcasts also have a website where each episode is posted, along with show notes, which often includes links to their guests’ websites.

Since most podcasters are constantly looking for engaging experts to interview, this is a relatively easy way earn relevant, high-quality links.

You’ll simply need to compile a list of relevant podcasts, make sure they include show notes with a link back to the guest’s website, and that you would want a link from their website, then reach out to the hosts about becoming a guest.

1. Start Your Own Podcast Starting your own podcast is a great way to reach a larger audience, but it’s also an opportunity to earn links by being included in articles featuring podcasts and/or individual episodes.

In order for the this to be effective, you’ll need to produce amazing content and differentiate your podcast in some, or ideally, several ways, to give people a reason to link to you.

This might include a tight focus on a specific niche, a unique skill, or a particular background, such as being a military veteran, religious leader, or a former professional sports athlete.

1. Make Other Link Builders Need You Do you accept guest posts on your website?

You should, because in addition to potentially getting great content for free, it also means that other link builders will need something from you, which gives you the perfect opportunity to ask them to link to some of the great content on your website.

When you receive the next email from someone asking to guest post on your website, take a few minutes to find a post on their website that’s relevant to a piece of content on your website, and ask them to include a link to it.

Since they’ve just asked you to do something for them, they are infinitely more likely to include your link in their content than they would be under almost any other circumstances.

1. Publish Unique, Difficult to Find Data Are you in an industry where data changes frequently and is relatively difficult to find?

If so, then it may be a good opportunity to create link worthy content based on that data. The key here is to go beyond the raw data and offer your own insight, making it entirely unique.

This is a critical step because data, on its own, can be easily copied, and rarely provides any context. This is where the opinion of a seasoned expert comes into play.

The post Brexit status of the UK is demoted to a “third country” and strict rules apply. This means that passports that were issued with a life of longer than 10 years validity will be invalid after 10 years.

In effect, a passport issued on June 30, 2012, could show an expiry date of March 30 2022. However, the same passport issued on June 30, 2012, is regarded by the EU as expiring on June 30, 2022, So any time beyond that will be deemed invalid.

How long can I stay in the EU? As the UK is now a “third country”, British travellers will have to comply with the “90/180 rule”

Both holidaymakers and business travellers can only stay 90 days (three months) visa-free in any 180 days (six months) anywhere in the Schengen area. To illustrate here is a scenario: you travel to the Schengen Area in March, April and May and leave before June 1; you then cannot return to the zone until August 31.

if you have already spent time in the Schengen Area in 2020 this won’t interfere with your allowance in 2021. The allowance starts on New Year’s Day.

Over the years, friends had warned me that the decision to let a cherished pet go was one of the most difficult they had ever made. At the time, I would nod and agree and move on with my day. We were definitely not “dog people” when, years ago, we got a call from a friend that their spouse, a vet, had a dog that needed a home. We had to look up the breed, Bichon, and when we did, we saw a fur ball that looked like it never set foot outside. This would possibly be a problem for our outdoorsy and active family. Nonetheless, we moved ahead with the adoption and never looked back.

We called her Coco, and the poor thing had rarely been outside of an apartment or walked much further than a few hundred metres from her home before she came to live with us. She joined a family of avid runners, hikers and annoyingly hyper people and her life changed in an instant. She may have wanted to go home during her first 10 kilometre hike but she soon became an enthusiastic adventure buddy. She overcame her fear of water to become an active kayaker. Well, to be truthful, I kayaked and she sat in the front, legs perched on the bow and nose in the air, sniffing the great smells. I know she was happy as she closed her eyes, let her ears fly back in the wind and joined me for hundreds of trips. If it was raining, we got wet, if it was cold, we shivered together and if it was lovely, well we loved every second spent together in the sun and on the water.

I think she was happiest when spending time with our children who were 11 and 13 when she joined the family. Coco went everywhere with us, wrapped in a blanket when going into stores or hotels with “no dog” restrictions. When friends teased us that we treated Coco as a human child, we would reply that she was sometimes the best-behaved child and we loved all of our kids equally. She didn’t look like the rest of the family because she was adopted.

As Coco aged, she slowed down (we all do) and she ate less, walked less and indicated that her body was giving out. She limped with arthritis, breathed heavily (and snored loudly), and had a stroke that left her temporarily paralyzed. In her last days, she terrified us when she had horrible seizures. After a weekend of seeing her struggling to breathe and watching the spark go out of her eyes, we knew that it was time to visit the vet.

The craziest and toughest part of life is that you can love people (and pets) with all your heart, and you can lose them long before you are ready to let go. Nothing lives forever, and although life is wondrous and beautiful, it is also far too short. I don’t know why dogs’ lives are a fraction as long as humans’, but I do know that we will live on, long after they depart, and there will be a hole in our hearts where they used to live.

Coco had an amazing life, filled with head scratches, tummy rubs and tons of table food (she shared many great meals with us, even though this was likely not good for her). Our house had a dog bed or blanket in every room and every corner had some reminder of this sweet little dog who shared our space: a dog bowl in the kitchen, leashes hanging on the door handles and a cute (but way too expensive) down dog jacket hanging in the cupboard. Strangely, it was her old torn and stained life jacket, a reminder of those many kayak trips, that brought on a wave of tears after she had died.

That last weekend was so hard on all of us, trying to thank this tiny sweet dog for 15 years of companionship, company and love. She left the world like she had lived: loving us and being loved right back.

Belief in paranormal psychic phenomena is widespread in the United States, with over a third of the population believing in extrasensory perception (ESP). Why do some people believe, while others are skeptical? According to the cognitive differences hypothesis, individual differences in the way people process information about the world can contribute to the creation of psychic beliefs, such as differences in memory accuracy (e.g., selectively remembering a fortune teller’s correct predictions) or analytical thinking (e.g., relying on intuition rather than scrutinizing evidence). While this hypothesis is prevalent in the literature, few have attempted to empirically test it. Here, we provided the most comprehensive test of the cognitive differences hypothesis to date. In 3 studies, we used online screening to recruit groups of strong believers and strong skeptics, matched on key demographics (age, sex, and years of education). These groups were then tested in laboratory and online settings using multiple cognitive tasks and other measures. Our cognitive testing showed that there were no consistent group differences on tasks of episodic memory distortion, autobiographical memory distortion, or working memory capacity, but skeptics consistently outperformed believers on several tasks tapping analytical or logical thinking as well as vocabulary. These findings demonstrate cognitive similarities and differences between these groups and suggest that differences in analytical thinking and conceptual knowledge might contribute to the development of psychic beliefs. We also found that psychic belief was associated with greater life satisfaction, demonstrating benefits associated with psychic beliefs and highlighting the role of both cognitive and noncognitive factors in understanding these individual differences.

The law of unfair dismissal is governed by the Employment Rights Act 1996. However, if you wish to go back to your place of work, the Employment Tribunal must consider it. If the Tribunal makes an order for reinstatement or re-engagement, the Employment Tribunal is also likely to award you compensation in the form of arrears of pay representing loss of hearings from the dismissal to the date of judgment or reinstatement.

If you do not wish to be reinstated or re-engaged, the Tribunal will make an award for compensation which comprises a basic award and compensatory award. The basic award consists of your gross weekly salary subject to a cap multiplied by the complete number of years that you worked (subject to a maximum of 20). A multiplier of 0.5, 1 or 1.5 will be applied to this depending on your age. The compensatory award consists of an amount that the tribunal considers just and equitable in all the circumstances having regard to the loss that you suffered in consequence of the dismissal in so far as that such loss is attributable by your employer. The compensation may be reduced if it is found that you caused or contributed to your dismissal.

Constructive dismissal You may have a claim for constructive and unfair dismissal pursuant to Section 95(1)(c) and section 136(1)(c) of the Employment Rights Act 1996 if you resign in consequence of a fundamental breach of contract without too long a delay after the fundamental breach arises. The most common breach by an employer is arguably a breach of the implied term of mutual trust and confidence. Essentially, if your employer has acted without reasonable and proper cause in a manner calculated or likely to destroy or seriously damage its relationship with you, you are likely to be successful in bringing a claim for constructive and unfair dismissal. You would need two years of continuous service to bring a claim for constructive and unfair dismissal, otherwise the claim will be for constructive dismissal only and your compensation is likely to limited to your notice pay. Unfair dismissal is nothing but when the employer terminates the employment of his/her employee on unfair grounds which are harsh, capricious, and indistinct or even without any reason. Unfair dismissal is when the employer does not have any valid or fair ground to dismiss the employee. In most of the cases, the employer terminates the employment of the employee unfairly under the garb of fair grounds of dismissal. The concept of unfair dismissal is easy to understand but difficult to define. One cannot give a definite list of all the acts which will amount to unfair dismissal or not. The term unfair dismissal differs from organization to organization and circumstances to circumstances. It depends on various factors such as the nature of the organization, working pattern of the employer, terms and conditions mentioned in the employment contract, actions of employees, etc.

It is important to keep in mind that a ground of fair dismissal should apply to everyone in such a manner which is uniform to all. For Example, if ‘A’ terminates the employment of ‘B’ on the ground of non-performance and gives another chance to improve to ‘C’ on the same ground of non-performance, then ‘B’ has been terminated unfairly and arbitrarily. The law pertaining to unfair dismissal is based on principles of natural justice and rationality.

To protect employees from unfair dismissal, it is very important to have strict laws with respect to unfair dismissal and not just this, it is essentially important to aware and educate employees about their rights in the case of unfair dismissal. There are various legislations protecting the interests of employees/labourers in India such as the Minimum Wages Act, Payment of Gratuity Act, Industrial Disputes Act, etc. Much legislation provide for fairgrounds of dismissal, however, none of the legislation provides for even the definition of unfair dismissal or what amounts to unfair dismissal, directly. The concept is wide and can be given zillion interpretations. It is scattered amongst various legislations and is not available at a single place. Often the ground of fair dismissal becomes unfair and the employer has the freedom to do whatever he wants under the blanket cover of fair dismissal.

What Are Fair Grounds of Dismissal? Before talking about what unfair dismissal is like, we must be familiar with the grounds for fair dismissal of an employee. Private sector employees can be organization staff or workmen. The term ‘workman’ has been clearly defined under the Industrial Disputes Act, and would mean all individuals employed in any industry or manufacturing or production unit but does not include an employee who is in a white-collar, organizational or decision-making role. The workmen are governed by labour laws like the Factories Act, the Payment of Wages Act, etc. The non-workmen are governed predominantly by their employment contract and the Shops and Establishment Act of the state in which they work. The employment agreement lays down the conditions for dismissal of an employee from the services. Usually, termination takes place as misconduct, discharge or retrenchment. They are related to misconduct, non-performance, lying about qualifications or experience, statutory restrictions, undisclosed information, information theft, willful insubordination or disobedience, scam or deceitfulness, determined damage or loss of employer’s property, enticement, regular unpunctuality or nonattendance, prominent illegally and sexual harassment, etc. But these fall under the category of fair reasons for the dismissal of an employee.

When Fair Becomes Unfair There are situations where the grounds for termination are subjective or blurred. In some cases, one can easily observe that these grounds were almost drawn to bring them under the purview of an employment agreement under the purview of the employment conformity, under the broad heads like non-performance or misconduct on the part of the employee.

On the whole, an employer has to establish the grounds of termination or dismissal before a disciplinary committee or the court. On 2 September 2021, the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021 (Bill) was passed by both houses of Parliament. The bill adopts several recommendations from the Respect@Work: National Inquiry into Sexual Harassment in Australian Workplaces which was published by the Australian Human Rights Commission in 2019.

1) Expanding definitions and extending time periods

The Bill will insert a new provision which expressly states that it is unlawful to harass a person on the ground of their sex. While sex-based discrimination is already prohibited under the Sex Discrimination Act 1984 (Cth) (SD Act), sex-based harassment that does not constitute sexual harassment (i.e. unwelcome conduct of a sexual nature) is not. Curiously, the new provisions will only cover harassment that is of a “seriously demeaning nature” and is not designed to capture “mild forms of inappropriate conduct”.

The Bill also clarifies that unlawful discrimination can be the basis of a claim by an employee under the SD Act.

Under the current regime, a sexual harassment or discrimination complaint made more than 6 months after the alleged conduct took place can be terminated by the President of the Commission. The Bill extends this period to 24 months recognising that applicants often delay making a complaint for reasons such as fear of victimisation or a lack of understanding their legal rights. The report also noted that for some complainants, the knowledge that their claim may be rejected because it is outside the time limit is enough to prevent them from making a claim at all.

In addition, sexual harassment in connection with employment will be expressly recognised as a valid reason for dismissal in determining whether a dismissal was harsh, unjust or unreasonable.

2) New ‘anti-sexual harassment orders’

Employees can now apply to the Fair Work Commission for an order to stop sexual harassment in the workplace. This new order will operate the same as the Fair Work Commission’s existing jurisdiction to make orders to “stop bullying”.

Whilst this amendment seems significant on paper, it is unlikely to lead to a significant increase in the amount of applications given:

THE Protection against Harassment of Women in the Workplace Act was enacted more than 10 years ago. Since then, as cases have gone before harassment committees and ombudspersons, parties have struggled to determine the scope of incidents covered by the law and the nature of employment relationships that fall within the law’s ambit.

The Supreme Court recently passed, for the first time, a judgment interpreting a key provision of the Act: the meaning of ‘harassment’. In ‘Nadia Naz v President of Islamic Republic of Pakistan & Others’, the Supreme Court stated that the meaning of ‘harassment’ in the context of the law is limited to harassment that is of a sexual nature. It clarified that harassment based on any other protected characteristic such as race, religion or ethnicity is not covered by the 2010 Act, and that conduct that is abusive or hostile, but not sexual in nature is not ‘harassment’.

The Supreme Court declared that the 2010 Act “confines or limits its application to sexualised forms, including orientation of unwanted or unwelcome behaviour or conduct displayed by an accused person towards a victim or any organization”. The Supreme Court further noted that the “aggrieved person under the [2010 Act] has the responsibility to prove that the perpetrator truly had an accompanying sexual intention or overture…”

The judgement, however, does not offer a thorough analysis of the meaning of sexual harassment. It begs the question: what is the scope of “sexualised” harassment and what is the nature of conduct that expresses “sexual intention or overture”.

Conduct that is rooted in gender-based discrimination and creates an abusive, hostile work environment must also be considered sexual harassment.

To understand the extent and nature of conduct that falls under the category of sexual harassment, it’s helpful to turn to guidelines of the Equal Employment Opportunity Commission of the United States, especially since the definition of the 2010 Act mirrors this guidance. The EEOC guidance states that sexual harassment includes “unwelcome advances, requests for sexual favours, and other verbal or physical conduct of a sexual nature” as well as sexual misconduct that has the “purpose or effect of unreasonably interfering with an individual’s work performance or creating an intimidating, hostile or offensive working environment”.

Sexual harassment is actionable conduct in the United States under the Civil Rights Act of 1964 which makes “it an unlawful employment practice for an employer … to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, colour, religion, sex or national origin”. The EEOC guidelines specify that “sexual harassment” is a form of sex discrimination prohibited by the Civil Rights Act.

Interpreting the prohibition against sexual harassment in the workplace, the US supreme court has emphasised that the key consideration is whether discrimination on the basis of sex created an abusive or hostile work environment for the complainant. One supreme court decision held that degrading comments addressed to a woman because of her gender (such as ‘you’re a woman, what do you know’, ‘we need a man as a manager’ and calling the complainant a ‘dumb ass’ woman) constitutes sexual harassment.

This interpretation was endorsed by the Lahore High Court in a judgement from 2019, which also favourably cited another US supreme court decision stating that “in evaluating the severity and pervasiveness of sexual harassment, we should focus on the perspective of the victim” and that “conduct that many men consider unobjectionable may offend many women”.

While Pakistan does not have anti-discrimination legislation of the scope of the Civil Rights Act in the US, Article 25 of Pakistan’s Constitution provides that all citizens are entitled to equal protection of the law. Article 25 specifically prohibits discrimination on the basis of sex. The Statement of Objects and Reasons annexed to the 2010 Act states that the “Act builds on the principles of equal opportunity for men and women and their right to earn a livelihood without fear of discrimination as stipulated in the Constitution”.

In light of constitutional obligations, how should we read the Supreme Court’s recent judgement? Sexual harassment cannot be restricted to conduct that is related to the act of sex. Harassment rooted in sex-based discrimination should be considered sexual harassment actionable under the 2010 Act, which must be read in light of Article 25 of the Constitution. This is consistent with the purpose of the 2010 Act to address gender discrimination that impacts women in the workplace.

The complete definition of harassment in the 2010 Act supports this view, as it includes “sexually demeaning attitudes”. While the court did not discuss the meaning of “sexually demeaning attitudes”, the inclusion of this phrase shows that the 2010 Act covers workplace conduct that discriminates against persons because of their gender and creates an intimidating or hostile environment.

The Supreme Court has recognised that while “anyone may be subject to sexual harassment, in a culture and society like Pakistan, women are the distressing majority of victims”. Women face pervasive harassment in the workplace when they are bullied, stereotyped and denied opportunities and benefits because of their gender. The judgement stated that the 2010 Act “rather than addressing the issue of harassment in all its manifestations … is a myopic piece of legislation that focused only on a minute faction of harassment”. This appears to be an unduly strong criticism of the law. While the Act is limited to sexual harassment, it nonetheless covers a wide range of discriminatory conduct directed to persons because of their gender that creates an intimidating, hostile or offensive work environment.

But a new study has found that African grey parrots volunteer assistance to both their good friends and mere acquaintances—even when there is no expectation of personal gain.

The paper, published in the journal Current Biology on Thursday, advances our knowledge of the evolution of cooperation and social intelligence, co-author Auguste von Bayern of the Max Planck Institute for Ornithology in Starnberg, Germany told AFP.

Both parrots and corvids (like crows and ravens) are renowned for their extraordinary problem solving skills, and are sometimes called "feathered apes."

Alex, the famous Harvard-based African grey parrot who died in 2007, developed a vocabulary of over 100 words, could identify colors and quantify objects up to the number six, among many other accomplishments.

But despite their impressive intelligence, earlier experiments have failed to show crows helping other crows—leading von Bayern and first author Desiree Brucks of ETH Zurich to wonder whether the same was true of parrots.

Working at the Loro Parque research station on the Spanish island of Tenerife, they placed pairs of grey parrots and blue-headed macaws in boxes alongside each other with an transfer hole between the two, and a hole facing a human experimenter that was either kept open or closed.

Both parrot species quickly learned that they could exchange tokens with the experimenter for a nut treat—but only the grey parrots helped their neighbors when their own hole facing the scientist was closed, preventing them from gaining any personal reward.

In the very first round, seven out of eight grey parrots were willing to transfer tokens in their possession to their neighbors so that their friends could feast when they could not.

Significantly, the grey parrots appeared to understand the nature of the task, as opposed to acting out of playfulness. When they saw the other parrot had an opportunity for exchange, they'd pass a token over—but otherwise, they would not.

Lending a wing

And, like humans, the grey parrots appeared to favor their friends, sharing more tokens with birds they had previously closely associated with, though they still gave some to acquaintances.

The experimenters did not test whether the effect would occur with perfect strangers.

It is not fully clear why the grey parrots acted "prosocially" while the macaws did not, but the researchers suggest it may be linked to how the two species organize themselves in the wild.

African greys live in huge flocks of up to 1,200 birds, Brucks told AFP, and this may require greater social cognitive abilities than macaws that live in much smaller groups of 10 to 30 individuals.

The team would now like to investigate how widespread cooperation is among the world's 393 parrot species and examine what evolutionary pressures led to it.

They'd also like to learn whether the birds are acting out of genuine empathy and if the level of help given is proportionate to the need of the recipient—for example, will a parrot who just had a meal receive the same level of assistance as one which is hungry?
